Timeline

Hello to all!

 

my case has been processing for 6 months at the Nebraska service center. Christmas Day will make 7 months. Well one site says 5/25 and another site says 5/31 🤦‍♀️. I’m going with 5/25. Anywho. My husband is going to need the I-601 because of his unlawful presence which would be techinall for 6 years because he came here as a minor and got into a little trouble as a teen. He was basically at the wrong place at the wrong time and got arrested for a crime of moral turpitude. It has nothing to do with violence against anyone. I’m alrwady seeing a psychiatrist and psychologist for past trauma issues I was having and found out this would help our case while being on this site and google. Is there any recommendations of what else I can do to make a stronger case? We are going to be married for a year. We have no children as of yet

The main aspect of an I-601 is showing an extreme hardship for the petitioner. What is the extreme hardship?

 

The process will be to have the I-130 approved, then sent to NVC. Then complete NVC processing (see http://www.visajourney.com/wiki/index.php/NVC_Process). Then you will wait for an interview to be scheduled. Then comes the interview.

Once he is otherwise determined to be eligible for the visa - which may not be right after the interview - he will be refused the visa due to the inadmissibility(ties). If waivable (what you noted is), then an option to file the I-601 waiver will become available.

ETA: ~1 year or so for the I-601 right now. A new medical exam will be required as the original will have expired by then (unless they somehow process the I-601 before it expires).
