Thanks for the reply and thats really helpful.

 

My only concern is my kids are 14 and one turning 18 next year, they are already included in our ROC in progress filing.

 

If we divorce Seems like they will be badly affected and will have to refile again their own ROC. Sorry if i miss something

 

seems thats how i understand it. Thoughts?

No you misunderstand. Your children are included on your petition correct? So if you change to a divorce waiver they go with you.
