Fiance's 17 year old daughter is pregnant

My fiancee's is in process of getting her annulment in the Philippines (she has court date in June). I was intending to file for a visa for her 17 year old daughter when I filed for the fiance visa for Noemi. Now, her daughter is pregnant will definitely have the child before the visa would be approved, and possible before the annulment is even finalized.

How much does the process change or is it now impossible to bring the 17 year old daughter to USA? Or will the daughters baby be able to come later on a different visa?

Hmm, thats an interesting situation.

Your step daughter could petition for the child to come to the US once she becomes an LPR. Although thats likely to take 5 years. Take 5 years to petition the child, not to become an LPR.

I think this is a situation where a consult with a lawyer would be very helpful. Mind, an experienced immigration lawyer with knowledge of FAMILY based immigration (specifically with the K1 and K2's). Good luck! Nothing simple is ever easy

At 17, even getting the AOS for her is not totally guarenteed. I know nothing about this myself though. I hope someone can give you a better answer.

Not sure how "out there" this idea is, but could your fiance legally adopt the baby after it is born, then you could petition for both the baby and the 17 year old daughter?

The child's father would have to give the ok to leave the country. Maybe you will have a real mess on your hands. If he desires the child to remain then little can be done until he gives permission.
