IR1 AOS package sent last week , layoff at company next week

Hi,


I'm on H1B and married US citizen last month,  We applied fo IR1 and sent out AOS package last week. 

Today I hear there will be layoffs in my office , and my team will get affected. 


My H1B is valid till Jan, 2020.  What are my options if I get impacted with layoffs ?

1. Will I be able to work on AOS EAD , assuming I get it within next 60 days. 

2. Find another job that would sponsor my H1B.

3. What will happen if I don't get job in 60 days ? Does that mean I am overstaying visa and that will ruin my AOS ?

  • 01-31-2020:- online status changed to "We mailed your card"       
  • 02-05-2020:- Received card in hand       

ROC:

  • 11/13/2021: I-751 package sent
  • 11/19/2021: Received case # via text message
  • 11/26/2021: Received NOA1 in mail, dated 11/18/2021

  1. Yes. Although it's taking ~4-6 months on average to get an EAD.
  2. This is a valid option.
  3. You will lose legal status, but a pending I-485 grants authorized stay while the case is processed. So no issue (plus overstay is ignored as a spouse of a USC).

FYI, IR-1 is a visa. You are doing AOS, not obtaining a visa.
