Hi all,

 

I'm the USC petitioning my spouse for a CR-1. At the moment I live and work outside the US, but my employer is American and will be transferring me to the US in a couple weeks. I have a signed transfer letter from my employer confirming my US salary and my start date in the US.

 

My question is what to put for "current income" on the Affidavit of Support. At this exact moment, my income is all foreign, which I understand means I have an income of 0. But given that I'll have a qualifying US salary in two weeks and I have documentation of that, should I use the salary on this transfer letter as my current income? Or do I need wait until my US start date to fill out the form?

 

I'm not sure if it makes a difference in this case, but we're filing DCF (Germany). I also haven't got my NOA2 yet, but I expect it to come in the next week or so, and because of the stress of the move, I want to have all the documents ready to go when Packet 3 comes.

employer is an American company so income would be that

don't forget the residency requirements to have US domicile/ others know more than  me as  what is actually required when u are working outside the country

Well, it's an American company with a German office, so I'm paid in Euros and completely within the normal German payment system. I don't get W2s.

I have an extension for my 2017 taxes, but I'll have filed them by the time I send in the packet 3 (long story...). I'm not sure what exclusion you mean. EDIT: Oh, I guess you mean the foreign income tax exclusion. I'm not going for that -- I'm using the foreign tax credit instead. But the 2017 taxes are fine and I'll be including that with my affidavit without a problem.

Your current income will be the stated salary on the letter from your employer.  That letter is also ALL you need in terms of evidence of intent to re-establish domicile in the US.  

Facts are cheap...knowing how to use them is precious...
