Hey guys, just a quick question.

 

If my partner found a job that was within the income requirement then how long after he works should we wait to file for the K1 visa? Should he work for an entire year before we file for it so we can show a tax return and stability etc? Or could we just wait, say three months of him working before filing and show an employment letter/pay stubs etc INSTEAD of the tax return (as he would probably be working for under a year at the time of the interview and wouldn't have one yet). Just worried that the second option might not show enough stability and I'm not too sure how important showing a tax return is at Sydney consulate. Also, we have a friend lined up who has agreed to and can meet the joint sponsor requirements/has tax returns. So could we just apply now if we wanted to?

 

Any help would be appreciated! Especially people that have gone through Sydney before!

independently of your embassy. i would highly suggest to use a co-sponsor. it seems from your statement that he has no proof of having enough income the 3 years prior for a k-1. also keep in mind that AOS will be 125% of the poverty line. you can file for k-1, but if there is not enough history of having enough income or assets for that matter, a co-sponsor will be needed regardless.

 

we didn't do a CR-1, but if you have not filed for k-1, it may be something you guys can still do and save some money and time with AOS. Meanwhile you both can earn a living and since you already have an alternative plan on waiting...CR-1 is anyways 12-16 month wait anyhow

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

When did he start work?

Will he have worked all of 2018? 

He has only just started to work. He will be working for 2 months and then coming here to visit me for 3 months and then going back and either resuming his job or, if he can't, finding another one that meets the income requirement. We were going to wait until after he returns to the US and gets a job again before we file for it.

We definitely plan on having the co-sponsor regardless.

when you do, if the sponsor is not the issue, my suggestion is to go for CR-1. K-1 is taking longer and longer and the AOS process is costly to say the least, plus other unforseen cost, when you get to the US w/o any income
