I've searched the forum, but the posts I found talking about i-864 didn't really clear things up for me!

 

My spouse is a US Citizen, I am Canadian. We lived together in Canada for a year and a bit, and now that his visa has ended, he is back in the States.

He didn't meet the poverty guidelines by himself for the past 3 years as he was a student, but he now works in his family business and will be earning enough this year to sponsor me.

 

Question 1 :

As I understand, should we put his current income as what we project he will be earning this year moving forward?

 

Question 2:

His dad owns the family business. My husband moved back into his father's home, where his brother also still lives. I will be moving to that household as well, after my green card is approved. Do we need separate i-864s for everybody? It's different people, but the same household, hence the confusion!

 

Question 3 :

Pretty sure of that one answer, but here it goes : I work full time in Canada and meet the poverty levels required. Can we combined Canadian income with my husband's to meet it (just so we have less people involved, less paperwork involved and less confusion) or is it just safer to use his dad? I could keep my canadian job while living in the states, but I'd rather not, but would keep it if it means and easier and smoother immigration proceedings.

 

Sorry for jumbled explanation. Just so utterly confused by all of this.

your income isn't included, yes he must put his current income

 

he must file the i864 and attach a letter explaining why he wasn't required to file taxes

 

no, there is no need for everybody to file the i864. if his dad is needed for the joint sponsor, he will fill out another i864. if he is married, his wife can file the i864A. they will include themselves plus any children that they claimed in their taxes as dependents

Rats. However, he did file taxes every year he was away from the US, as well as Canadian taxes.

 

So my husband files the i-864 as a joint sponsor or as the main sponsor? And his dad fills out another i-864? His dad is divorced and lives alone with his two sons ( my husband and his brother ) so nobody fills out i-864A?

Your income will only be counted if it will continue from the same source once you move to the US.  Will it?

 

Otherwise, Dad's household is himself plus you and any unmarried children under 21, no matter where they live.  Your husband is NOT an unmarried son, so not part of Dad's household.  Sounds like one I-864 from your husband as primary sponsor/petitioner and one from Dad as the only joint sponsor.

Facts are cheap...knowing how to use them is precious...

Yes, my income could continue potentially - in my line of work, I can commute from anywhere in the world, I would just rather not, or not for very long anyways, which may be just useless. I was just willing to stick it out a bit longer if it meant a smoother immigration paperwork (ie less forms) but if its just one 864 from his dad and one from my husband that sounds great!!! Thanks a lot! I think we will go that way since my father-in-law and my husband have permanent jobs and I'd be most likely quitting mine after a while!

Be sure to study the form instructions carefully to make sure you send the correct supporting documents with the forms.
