When I sent in my AOS application, my husband only has 2016 tax forms because he extended to file 2017 one till August. Now, we are filling the 2017 tax forms.

Should I send 2017 tax forms  to uscis or wait for RFE? Because I know that on September 11, uscis will just deny the case without sending necessary forms, I am scared of that if they didn’t look into my case after September 11, they can just deny my case.

Also, I wonder if I have to send 2017 tax forms, do I have to fill out a new I-864 form?

Anyone knows ? Thanks

Did he send evidence of his 2017 extension filing? If so, it should be accepted, or at least get an RFE or let you present it at the interview.

We didn’t send evidence but we sent a letter saying we extended filing.. No RFE yet. I think nobody look into my case yet. I am a bit worried.. I think I have to call them, but most of the time tier1 doesn’t know much..

We kinda went thru the same scenario, in our case it was 2016 extension when we submitted our AOS application last October 2017. We included the request for extension form that we sent to IRS. Now with our upcoming interview next week. We will be bringing an updated i-864 form with the latest tax forms since we now have the 2016 and 2017 taxes.
