Sorry to ask, because this question has come up so many times before. We're waiting for a K3 interview in Montreal, and just received the Affidavit of Support Bill for I-130. How do I let them know we'll Adjust Status once he gets here on K3?

I-129f sent April 24, 06

approved July 27, 06

Montreal interview Jan 18, 07

POE Toronto Jan 28, 07

EAD sent Jan. 30, 07

transferred to Vermont Feb 12

biometrics Feb 22

card returned undeliverable! March 27

called after 6 weeks to have EAD re-sent

AOS sent Jan. 30, 07

biometrics Feb 22

RFE for complete medical (!) Feb 23

Called Senator from NJ - never returned call

Infopass March 19 (no help)

Replied to RFE with duplicate medical March 19

Sent additional evidence (I-693A) March 26

Just wait until you get to the states and file for AOS, no need to let them know anything before then.

From what I understand, you don't need to take any direct action with NVC for the I-130 if you choose to pursue the K-3. Just like the post stated prior to mine, once you begin the AOS process, it will override the pending I-130 at NVC. Do you have your interview date yet?

Normally the 1st thing one gets from the NVC when their I-130 petition is approved is a DS-3032 Choice of Agent and Address form. That's the appropriate time to tell the NVC which way you're going to go.

Yes, the Choice of Agent form was included with the Affidavit of Support bill. If this is the appropriate time to let NVC know we'll carry on with K3 and adjust status later, how do I do this? Write? Call? Email?

I suppose some people do nothing, since there's a one-year grace period to pay the $70 Affidavit of Support Bill. I guess they simply pick up where they left off when they Adjust Status.

By the way, no inteview date yet and it looks grim from what I gather from other Montreal people. Travelling there in winter can be trecherous. Sigh... how many grey hairs have you gotten this year?

You can delay the NVC process of I-130 by not sending anything right now. When you get your K-3 interview date and get the visa, you can simply email NVC that you won't pursue the CR-1.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Gray hairs? I lost count! And I already paid the AOS bill for the CR-1 essentially having given up hope for my K-3. But now that I have hope again, I'm so relieved I haven't paid the $380 IV bill fee yet :yes:

I'm going broke AND gray during this whole immigration process. Hope my husband still wants me when all is said and done.... :lol:

Write the information on the DS-3032.

In line with what simple_male posted, you may either want to go slow responding to the NVC or respond quickly going forward with the immigrant visa since you don't have an interview date for the K3 visa application. You may not want to close off your options quite yet.

Tough call to make - whatever decision you make, make it and don't look back.

I-130:

25 Aug 06 - Sent I-130 (a Friday)

28 Aug 06 - NOA1 & Certif. receipt returned ( a Monday) Day 1

29 Aug 06 - USCIS cashes check

30 Aug 06 - check cleared & 1ST TOUCH.

01 Sept 06 - NOA1 recvd by Mail

09 Sept 06 - 2ND TOUCH (a Saturday)

09 Mai 07 - NOA2 (2 e-mails)

Note: were told the long delay due to huge backlog and internal changes in VT

NVC :

04-June-07 - NVC generates DS-3032 & AOS bill

12-June-07 - AOS Bill payment sent/ alien receives DS-3032 form (by mail, dated 4th June)

13-June-07 - Alien sends back completed DS-3032 (by mail)/ rcvd 19th of June approx.

To mid July-07 - I-864 form sent completed and IV fee bill

19-July-07 NVC rcv I-864 form; mail signature rcvd.

22-Aug-07 Ds-230 with documents sent to NVC.

20-Sep - 07 Alien sends NVC Missing document. NVC receives it the 25th.

05-Oct - 07 NVC completed.

16-Jan - 08 Interview, 3 questions asked, visa approved same day, received 1week later approx.

Note: delay due to internal delay, missing document (not rfe) and self procrastination of understanding some abstract terms. C Post not at all reliable (delivery duration, delivery with signature (did not deliver personnaly), and delivery of interview letter rcvd after the interview).

In USA:

01-03-08 POE Entry in USA

...-03-08 2 Welcome in America letters and green card received.

A word of caution -- don't close off your options yet -- the way NVC was processing my I-130, I thought it would beat the K3, but then it all came to a griding halt. My wife just cleared her K3 interview this week.

2006-03-02: NOA1

2006-07-24: NOA2

2006-07-31: Case received by NVC

2006-08-01: Case leaves NVC to New Delhi Consulate via DHL

2006-08-04: Case received by New Delhi Consulate

2006-08-08: Packet 3 mailed out by consulate

2006-08-17: DS-230 Part I couriered to consulate

2006-08-23: Got interview date (email and telephone confirmation)

2006-08-28: Picked-up packet 4 from the consulate, counter 16 (between 2 PM and 3 PM)

2006-09-20: Interview Date (VISA Approved!!!)

2006-09-23: Picked up Passport with VISA from Blue Dot courier office (VFS did not hold it)

2006-09-27: Reached Home!!! (POE Chicago)

I-130 TRACK

2006-02-08: I-130 Sent

2006-02-27: NOA1

2006-05-03: NOA2 (Approved)

2006-06-12: Received and entered into NVC system

2006-07-08: Self Generated DS-3032 and sent to NVC

2006-07-08: Received I-864 bill from attorney

2006-07-12: Received IV bill

2006-07-17: Receive I-864 package

2006-07-19: Send back I-864 package

2006-07-19: Pay IV bill (was out on vacation)

2006-07-31: Sent in self-generated DS-230 (after NVC was ready)

2006-08-03: Case being reviewed by NVC (per operator)

2006-09-12: Case sent to New Delhi Consulate

2006-10-04: Emailed Consulate and got Original Interview Date (10/20/06) posponed to April 2007

kpathak...my I-130 did exactly the same thing! I was hoping to be able to proceed with the immigration visa rather steadily once it got to NVC, but now I'm even more thankful that my K-3 option is still open and progressing because it's been 3 weeks since I've heard any more news about the I-130....
