Tax return and K1 visa help

So here is our current situation, I am 22(M) and my fiance 25(F) are currently talking about the process of filing for the K-1 Fiance Visa. One of the issue that we are worried about is that I have recently just graduated from a university and have only less than 1 year of tax that has been filed with my income as I have just gotten my very first job during my last year in college and have no prior source of income before that. But fortunately, my mother has filed for my taxes at least 3 times before. Also, I will be starting my new job which will put be at 125% the poverty line, what potential issues should we look out for when it comes to tax returns when we start our K-1 Visa process?

Assuming you are going through Manila (based on your profile flag), you shouldn't have an issue. Manila COs rarely request an I-134. But you should have one ready to present just in case.

 

You lack of previous tax returns is not a big issue. Your current income is best demonstrated via your current employment and evidenced via pay stubs and an employment letter.

 

Once the beneficiary enters on the K-1 visa, marries within 90 days, and you file for AOS, you will need to submit an I-864. For this, you would provide the same documentation plus at least the most recent tax year's tax return. If you haven't filed for the past 3 years and were not required to file (i.e. you had no income or below the income threshold required to file), then a signed letter stating that you were not required to file for those years needs to be submitted as well.

1/2/18: EAD + AP approved (no website update), 1/5/18: EAD + AP mailed, 1/8/18: EAD + AP approval notice hardcopies received, 1/10/18: EAD + AP received

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

K-1:

12/1/16: sent, 12/14/16: NOA1 hard copy received, 3/10/17: RFE (IMB verification), 3/22/17: RFE response received

4/6/2017: Received, 4/12/2017: Sent to Riyadh embassy, 4/16/2017: Case received at Riyadh embassy, 4/21/2017: Request case transfer to Manila, approved 4/24/2017

 

K-1

5/1/2017: Case received by Manila (1 week embassy transfer??? Lucky~)

7/13/2017: Interview: APPROVED!!!

7/19/2017: Visa in hand

8/15/2017: POE

make sure you have a latter from your employer on their letterhead stating your salary and position status, xxx Dollars Full time employee, should be fine
