Hello everyone..

I'm in a bad situation. I married my wife April of 2017. Processed her paperwork that summer of July 2017.got the uscis approvel February of 2018. She got her interview June 7 2018. Sounds all great was beyond excited! She walks into the court and my divorce paper was rejected because it was a religious decree that was obtained to me by the lebenase courts clerk recently.i finalized my divorce August 16th 2016. They gave her a white refusal paper (221g) saying to mail in my government divorce paper from the courts clerk with her passport. She ended up going to the court clerk to request my divorce paper and they had nothing available in the system for me!!!!!! They had to re-register it for me which took 3 weeks !!!! And it was updated to 2018 not the actual date of my real divorce.They called her today and told her we cant accept this, because ur marriage happened   before the divorce. It wasnt denied but put back on administrative processing. My Lawyer emailed them to  see what they need in order to make everything work. Does anybody have hope for me ??

I read a case similar to this less than two weeks ago on the forum, please try to look it up as well as a few others I’ve seen in the past. It seems like this is a regular thing with these divorce decrees in those places that have that requirement. Hope it works out for you.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

You need more than hope.  You need a solution.  You have a lawyer.  Follow their advice.

They're sending it back to uscis to intent to revoke whatever that means . I hope uscis sees I withdrew from my ex petition .cancelled her paper work before they approved it. I send uscis my religious divorce decree . dont no how they accepted that!!!!! Wish they would of denied it before it got to the embassy.lawyer told me they should of never rejected it because it was stamped by lebenase Council in 2016. I mean the embassy didn't see I didnt allow my ex to come to the states!!! This isn't fair. Now im moving to a third world country until they approve my wife cause I hate being in a long distsnce relationship

I suspect you'll need to withdraw the current petition and do whatever you have to do to have a legal marriage on a date that comes after the date your former marriage was legally terminated.  You are right, USCIS should not have approved your petition.  What's done is done.  The next step is to clean up the actual marriage mess in Lebanon and then start over.

 

There is no reason to wait months to hear from USCIS and try to get the current petition approval reaffirmed.  Withdraw the petition, fix the marriage legalities, and file again, in that order.

Uscis usually takes a while to hear from them when it's send back???

Yes, but there's no reason to wait.  I gave you three things to do and an order to do them in. Every day you delay will be one day longer you are apart.  You have NO chance of being together any other way.  NONE
