HI Yall,

So I'm ready to file I-864 for my spouse, I have couple question I want to clarify?

 

1. I started my job this month, got my pay stub and income meats the I-864 Poverty Guide lines, but I read somewhere about submitting last 6 month pay stub, so question of clarification is that, is it must to have last 6 month pay stub ?. Or I will be ok with one pay stub with letter of employment verification?

 

2. I came in US 2016 and due to no income, I had not filed tax in 2016, but have filed taxes in 2017, So for 2016 what should i do? Either file tax now showing zero income?

Write letter of explanation of why didn't file tax?

 

3. Last question, I have 1 job now and just started another job, Should I submit both jobs pay stub, first job meets the poverty guideline requirement? second job i started I have not received my pay stub yet?

  1. What matters i current income. That said, having a history of stable income certainly helps. There is no requirement for 6 months of pay stubs, but generally having at least a few paychecks will help. If not, you send what you have. The YTD earnings on it will basically confirm how long the job has been held anyway. The CO/IO makes the determination based on the totality of the circumstances.
    1. Is this for AOS or an immigrant visa abroad? If abroad, what consulate/embassy? Some can be more strict with the I-864 than others.
  2. You can either file first OR you can provide a signed letter stating why you were not required to file for 2016.
  3. I would send documentation (pay stub + employment letter) for both jobs and include the income from both jobs on the I-864.
    1. Is there a particular reason you can't wait for at least one pay stub on the new job? I know it's a little extra wait, but typically this is a matter of a week or 2.

2. it's in Islamabad embassy, normally they are more strict, but we'll see how it goes???

3. there is not quite rush, I submit civil docs and NVC said, i864 is missing, i just don't want to stretch to long, but I will definitely wait?. on my first job, it meats the income of 2, as of 2018- is 20,000+ and mine is 23000, on second its 24,000+, if i attach it will be better but i'm just rushing?

I probably would look for a co-sponsor just in case the co determines that you need one, you are cutting it close on the income requirments and do not have a long enough income history

but If i add both incomes that's about 47000+, more than enough?. Poverty guide line for 2 is only 20,000. I can have someone co-sponsor , but I would rather not? Having some one co-sponsor is too much of a headache, all my family members have sponsored other so with current income they can't co-sponsor me? and how long after you can sponsor other individual after co-sponsoring one?

I think the 2 jobs (especially if you have assets to supplement it) would be sufficient for NVC. It might not be a bad idea to have an I-864 from a joint sponsor on hand to present at the interview, if needed. I don't think it's necessary, but having it on hand may avoid a 221g to find a joint sponsor.

with my 2 jobs i have litttle saving in my account bcuz i was living with my family? its about 8-10 K. I also included that with current month statement

HOPE everythings work out!.

I'm little confuse here, can someone help, its just me sponsoring my spouse??, I put 1 in part 3-principal immigrant?

 

so 1- part 3 numbered entered was 1? so I put 1

 

2. Put you self- so I put 1 for my self?

 

3??? i'm married should I put one or not> I know it says person NOT sponsored but my mind is not working write now

 

If i add 1 on number 3, currently married, it becomes 3, but household is only 1

The above image is correct (not the blue edits). Your spouse would be included in #1 so therefore should NOT be included in #3.

My brother co-sponsor me 4 years ago, can he sponsor my husband after 4 years now? my dad said u can co sponsor another person after 3 years

There's no time limit to sponsor somebody...it can be day 1 after becoming a green card holder.

That said, if you are a green card holder still, then he would need to include you in his household size on the I-864 (#6 in the image above).

ok, I was just reading about it as well, but my brother so far co-sponsor me and my mom, we both are here for 3 years now. if he co-sponsor my husband he has to meet the minimum household requirement of family of 4, which is 31K+, and including him, me, mom and husband, poverty guideline goes upto 31K, he doesn't make more than 25K+, he is self employed, he can show more but it's just another hassle. If u think that's not an issue, then i'll have him co-sponsor my husband

It sounds like he would not be a qualified joint sponsor if he makes under $31k given his household size.

Being self-employed, tax returns would be the primary evidence of income. So he wouldn't be able to show more (at least from the self-employment income source) until he filed 2018 taxes.

 

I don't think a joint sponsor will be needed...it's just not a bad idea to have one ready when the interview comes around just in case it is requested.

Agreed!. But he is a student and drives Uber, He will be starting some another full time job soon. I think I should get both job pay stubs and submit and hope everything works out. 

I'm gonna ask this last question here? what should I say in a written explanation for not filing 2016 tax, i didn't filed bcuz i had no income? any suggestion will be appreciated? I skim through couple samples but still little confused,

I would like to know how it turned out for the op?

 

I'm in a similar situation. I just started a new job that pays well above my required income along with my self employment but I only have one paystub to show for this job. I have been working prior to changing jobs, I only changed because there was a big pay increase.

 

Will one paystub be good enough for this situation?
