Hello 

 

I'm about to submit my ROC form I751.

I have a son who obtained his green card at the same time and who entered the country 1 month after me.

I read that I can include him under part 5 but I'm confused about the fees.

Do I pay $595 + $85 for each of us or just once?

And is it a big deal if I submit the form 2 months before my green card expires instead of 3 months? I'm waiting for my divorce decree. The court appointment is in a month.

Hello Helena,  the law to file your ROC IS 90DAYS/3 Months. I would suggest  you file in time. Remember the Divorce case can take longer than expected. A friend had a bad experience  as a result of delay in getting his Divorce Decree and it resulted  to lot of issue for me.

Actually the law says you can file ROC anytime during 90 days window. It can be 3 months, 2 months, but you can as well file 2 weeks before your green card expires.  So if OP wants to file 2 months before expiration date then it's perfectly fine.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.
