Fiancee's son?

Timeline

My attorney informed me after reading my fiancee's divorce decree and custody papers that her ex husband would not have to sign fo my fiancee's son to come to the US with her. Her custody paper basically states that she has full custody of her son, but her ex husband has visitation rights. Does anyone know if she needs her ex husbands signature so her son can come to the US and live? What kills me is the fact that he won't sign it, because he just wants to hurt her more than he already has.

I sent our application in with her son's name on it, meaning we applied for him also. If her son cannot come with her and she is still willing to come here, will this create a problem at her interview? Or will they approve her Visa and deny her son? Everybody please say a prayer for me, I want her and her son to come to the US, because I love her son very much!!!

Timeline

It is US requirement that both natural parents consent to a child being brought to the US to live, regardless of the custody arrangements or visitation rights of the absent parent. This is not something that is required, usually, by the home country.

I had to take my ex-husband to Court to gain permission to bring my daughter to the US. It was painful for me and my daughter and my husband (then fiance) had to fly from the US to the UK to appear at the hearing. It was a nightmare............but we won!

You are required to enter the names of any children on your fiancee's I-129F. If the child wishes to emigrate with the mother then the appropriate forms have to be filed, seperately. One of my son's, who remained in England was on my I-129F, but did not want to live in the US, so we never filed an application for a K-2 for him. But, should he have wanted to join us, within a year of me obtaining my visa, he would have had the option to do so because he was listed on the original petition.

Thanks for your support! He is 5 years old. This morning before I went to work, I had a chance to chat with my fiancee and her son, and he was so happy to chat with me and see me on the webcam. He asked me if i can come there for one day so we could play :crying: . Then he said he wants to come here so we can swim, and play. My nerves are shot now. I hope to change his mind!

I have been thinking about this for some time. I know this is a tough situation to be in. Keep your spirits up. Somehow you and your fiance need to convince the father that the child will be going to a good home. Did you meet the father when you visited your fiance? Maybe if you go again, could it be a good idea to meet him personally? I know you and your fiance knows best. I hope everything will work out. Good luck.

My fiance has a 15 year old son. At her annullment she was granted full custody. Her son's birth cert does not have a fathers name on it. The box that the fathers name goes has N/A. Will we have to do anything to get her son into the country? Her ex will not under any circumstances agree to sign permition for him to come over.
