Hello everyone,

I need some clarification please. Anyone advice will be welcomed. I filled online my N400 throughout marriage under the 3 years rule. My husband has a child from his previous marriage and has been paying child support religiously. The child and mother are both USC and live in the US. On my application, I listed the child as stepchild. But now I am requested to provide proof of child support payment. I don't have any legal right on the child since the parents are both alive. So all documents will prove that my husband has been paying the child support but not me. So I don't know how to proceed with this since I am the one applying and not my husband.

Anyone has been in this situation?

I'm assuming your husband is paying it via Child Care Services of that state. All Child Care Services have an online account. You could get the payment information from there and upload it as evidence. I'm also certain they have asked you for your marriage certificate. The person reviewing the case will connect the dots.

No, he send check every month. Thank you for your advice though. Yes I submitted a marriage certificate. I am just surprise that they need child support proof for a step child.

You could ask have the Child Care Services provide a Statement on Child Support Payment. You could also have your Husband's ex-spouse provide a notarized letter saying your Husband is up to speed on all payments.

 

I think (which is a guess) that they want to ensure that you and your husband are both of good moral character.

Keep in mind not every state / county requires payments be made through government agencies..

 

My last divorce in Oklahoma was just a direct payment to my ex, no government entity involved.

Yes, same thing with my husband. He writes a chech every month to his ex.

I may have to make the request to the ex wife though since my husband writes her a check every month. Thank you natvyas.

Could you include a copy of the support order as well as copies of the cashed checks?

Did you get a letter from USCIS asking for this proof of payment? 

 

I was in similar situation but applying under 5 year rule and was not once asked to show proof of payment. And my husband did not have court order or anything like that but he sends check every month religiously as well and so I guess 2 ways to show this: one is to get notarized letter as someone already mentioned, two is to print all those cashed checks to his ex wife (my bank lets me do this online).  My husband always writes "child support for xyz month" on the memo so it's clear what that is for. I hope for your husband's sake he does write "child support" or something along this line on those checks.

 

If you apply under 5 year rule, they may not even ask you this ... just based on my personal experience anyways because now you're applying not based on marriage anymore .... worth to think about.

Thank you for your response. I did not receive a letter from them but when I was filing online they asked to upload child support proof along with green card, marriage certificate.... And yes I am applying under the 3 years rule.
