If anyone can help with my question below or provide any input - it'd be appreciated!

I am a US Citizen and petitioned for my husband.  We did the I130, the I601a waiver, finger prints - all went well here in the US.  My husbands interview date came and was in February.  My husband has never had any problems with the law and has never been in any trouble.  We, being my husband, attorney and myself were confident that the interview would go smooth.  At the time of the interview, the officer asked my husband if he had ever had any trouble with the law or ever been in prison, my husband responded "No, Never", officer states that their data base pulled his name as committing a felony and being in prison and denied his visa.  My husband has now been in Mexico 4 months and we have been trying to sort all this out.  Apparently an individual was in prison for 6 years with an alias using my husbands name.  the attorney and I have found all evidence proving this person is not my husband (court documents, mug shot even family pictures of us during the time this person was in prison...etc..) and have submitted all to the embassy - now we are just waiting on a response. Does anyone know how long it takes the embassy to re-review evidence we submitted showing that they are confusing my husband with another individual...??  We have 2 boys (5 & 7) and they are constantly asking for their father and we have made numerous trips to visit, but being apart is really unbearable.

I sadly cannot give an exact time but I did see of people who talked about 3 weeks to 1 months (sometimes more). How long since the documents were sent? I would email the embassy to make sure they arrived and wait then a week or two and then ask again if there's any news.

Nov. 2016 - NOA1 

April 2017 - NOA2 (6 months!)

April 2017 - Arrived to NVC

April 2017 - Got the # from NVC

May 2017 - Case left NVC

May 2017 - Arrived to Embassy

May 2017 - Got Package 3 

May 2017- Got Package 4

May 2017 - Interview [APPROVED!]

June 2017 - Visa arrived home

June 2017 - Made it to the US. Finally with my future hubby!!

July 2017 - Married!

AOS Process

August 2017 - Started AOS

August 2017 - NOA1

Sept. 2017 - Biometrics

19th Dec. 2018 - Interview date  [16 months]

Dec. 2018 - GC processing

29th Dec. 2018 - GC arrived home! [10 days!]

We submitted proof originally in March and the additional info end of April.  My attorney emailed the embassy almost 2 weeks ago, but nothing yet... just getting anxious and frustrated...thanks for the response.

I strongly advise you call them yourself. Continually contact them yourself until it is resolved
