Regarding Change of Status

Hi I would like to know if all of those applicants for change of status will undergo interview or it is random? Also when submitting the I-485 can I also submit the Form I-765(permit to work) Form -131 (permit to travel) Form -864 (affidavit of support) and Form -693(medical-vaccination) and I-94(record of entry). Do we still need to submit Financial Prood like paystub?  Thanks for help.

What are you adjusting from? If you are submitting i485 based on marriage you will need to submit i864 and all its required supporting documents, which means tax returns, pay stubs, etc. EAD and AP are also submitted along with AOS. USCIS has a pdf with instructions on the i485 that tells you all of the required paperwork and their respective supporting documents for each type of adjustment of status. Look yours up and see what all you need. 

 

You only need to submit medical if you didn’t get a medical done for your visa within the last year.

Depends on what basis you are doing AOS (not COS...that's for changing from one non-immigrant status to another non-immigrant status).

Doing AOS under a K-1 visa after marrying within 90 days is eligible for an interview waiver. Who gets one or not is just luck + providing a sufficient amount of relationship/marriage evidence (too little is likely to get one, anything else is random).

 

The I-864 must be submitted with the I-485.

All supporting documentation to go with the I-864 must be provided as well. This includes pay stubs, an employment letter, etc., as well at least the most recent tax year's federal income tax return (you can provide more if desired but it's not necessary). Sending a tax transcript (https://www.irs.gov/individuals/get-transcript) is the simplest way to meet the tax return documentation requirement.

 

The I-765 + I-131 are optional but highly recommended. No fee is involved in this case.

I-693 is not required with the initial filing but is required before AOS is approved, although if you're doing AOS form a K-1 and your medical is less than 1 year old, you shouldn't need to submit this. A completed vaccination (DS-3025) record may be necessary, though.

A copy of your I-94 (https://i94.cbp.dhs.gov/I94/) should be sent as evidence that you were inspected and admitted into the US.

So generally interview is random. Do we need to submit pictures of the wedding? How about the vaccinations still need to certify if to USCIS Accredited Surgeon or wait until they will require? Thank You

It's not required to send wedding photos, but just a couple to include is fine as well. Evidence of a bona fide marriage is evaluated base don the totality of the circumstances, not any single piece of evidence or ceremony. The marriage certificate is all the IO needs to confirm that the marriage is valid (along with any records of dissolution of prior marriages, if any).

 

If the DS-3025 is marked as "US vaccination requirements COMPLETE" and is signed by the panel physician already, - and the medical is still valid (less than 1 year old) - then no US Civil Surgeon is necessary.

This has changed. A recent memo removed fiancé (and employment based) visas from the “eligible for interview waiver” list.

And how to I get Alien Number since I am still on K1 Visa now? Should I apply for it or they will issue it once I submitted my Form - 485

Thank you. How about Alien Number should I apply for it or they will provide once I submitted the Form 485? DS 3025 no need to submit or still need to send them a copy of it?

Thank you!!! I heard rumors of it changing for about a year now, but didn't see anything official. Looks like this changed on May 15th. I see the USCIS policy manual updated and no longer lists K-class applicants as being eligible for a waiver.

Looks like everybody coming form a K-1 will have an interview now.  Bleh.

Does anyone here knew how long will you be notify through email or postmail regarding change of status from K1 to conditional immigrant. Just sent my I-485 I-765 I-131 last July 6, 2018 and received July 9 Monday. Any info? For those who have it already how long will it take for you to have Biometric Appointments and Is there any interview and how long did you get your Conditional GreenCard. Depends on your local USCIS office and their backlog. It's typically about 6-12 months, although some field offices have an 18+ wait still.
