Hey all,

Still trying to figure out the nuances of this @@@ form. I have the correct numbers for income (taken from B's IRS transcripts) so that part is no longer a worry. We also have a joint sponsor that alone more than covers the 125% poverty line thing.

One question remains though.... Bren is a grad student doing ONLY research (meaning he is not being paid at all, no TAship, no bursaries, not a darn thing) so.... do I put "unemployed" on question #22? He stopped being a university employee in September. We would/could get a letter from the U. saying he is in good standing as a full time student, but I really don't see the point. What'cha all think?

Help would be appreciated!!!

Sounds like "student" is the correct answer since he is a grad student and does not earn money.

I would check the box for "unemployed" and in the blank for "since" indicate the date last employed followed by "graduate student".

Facts are cheap...knowing how to use them is precious...

I asked the Embassy in Frankfurt this same question, as I am currently a graduate student in the United States, living in Germany, and writing my dissertation. Thus I have no current income. I asked whether being a student counts as employment, but they said no--just to check the unemployed box. It might be good to have a letter from Bren's university, saying he is a student since that explains his lack of income. I know another member on VJ who was a grad. student and did submit such a letter. I did not have such a letter, but primarily because we qualified because of a job contract I have in the States for this coming year.

In any case, if Bren does not get such a letter, I'm sure you will be most likely be fine since you do have a joint sponsor. I do think it could help your case, though, because then it's clear that Bren does have a current occupation, which even if it isn't a lucrative one at present, has promise to be so in the future.

December 11, 2006: I-130 Petition signed for in Frankfurt.

December 21, 2006: Credit Card charged $190.

February 6, 2007: Heard back from Frankfurt. They want proof that our relationship is bonafide.

February 8, 2007: Sent proof (old emails, joint bank account statements, story of how we met)

February 24, 2007: I-130 Approved. Received Packet 3 in the mail.

February 26, 2007: Faxed OF-169 (checklist) to Immigrant Visa Unit in Frankfurt; Mailed back DS-230 Part I

March 2, 2007: Received Packet 4 (Interview Appointment Scheduled)

April 2, 2007: Interview in Frankfurt; Visa Approved!

April 5, 2007: Visa received.

June 27, 2007: POE Boston.

July 23, 2007: Went to local social security office and applied for number in person (although D had checked off the box to receive one on the DS-230).

July 30, 2007: Daniel received his social security number and greencard in the mail.

March 31, 2009: Mailed I-751 to Vermont USCIS

April 2, 2009: I-751 application received (saw this with USPS tracking)
