have a question regarding my greencard.

My grandfather (petitioner) applied for my dad (principal) on greencard in 2004, and we were accepted in 2006. Sadly, my grandfather died last year, and my father is in Egypt. However, I have been studying in the US for three years now. Last month, our priority date became current. So can we still get the greencard or I would need to go back to Egypt after graduation. Sec 204 maybe ?

Nope I don't think so. Your main sponsor passed away so there is no family to reunite.

The beneficiary, which is your father, would have to be the one. I’m not sure how he qualifies if he’s living in Egypt.

I’m also not sure in general, we’ve seen a few people in these forums try for relief after the death of a petitioner, I don’t recall any of them reporting a successful outcome - not sure how representative our VJ sample would be.

I turned 21 last month.

Well, good luck, please let us know how it turns out, would be nice to see a successful outcome on this being reported here.

As i said above I personally do not recall in these forums seeing anyone reporting success after death of petitioner, doesn’t mean it never happens, maybe others know of successful cases. 

 

I also have no idea what would happen to you, if you would possibly be at risk of aging out through the process even if successful. Nothing happens fast with uscis.

Siblings can sponsor you and it will take plus 10 years. 

 

Sorry but if your grandfather passed 12 years ago I'd say there is no chance for this sponsorship to work. Maybe if that would happen recently you'd be able to pick it up but let's be real here - that petition is pretty dead by now. 

 

Not to mention your father would need to immigrate first and then you.
