AOS interview successful, but waiting for FBI name check

Congratulations! This is good news and gives us some hope since we are 11 months behind your date.

hi all,

so it took more than three years (and more than four if you count that it took INS a year just to issue the first notice of action)--but I'm now a permanent resident! just got my greencard in the mail -- the holograms are cra-zy.

12/06 FBI background check finished after 2 years

7/07 after 7 months Indianapolis sends request for new bio metrics (made numerous inquiries to NSC and senator)

7/17/07 Bio metrics done again

8/8/07 Received request for further proof of relationship

8/13/07 Bills, photos, letters showing proof received by Indy

9/10/2007 Finally the card production and welcome letter email received

but why post it here? wouldn't it, if applicable in a larger scope be better as a stand-alone thread?

I guess I am just a little sensitive that we, the STONE AGE TIMERS thread are told to SHUT UP. You posted it here, in any other situation that would be because it is applicable HERE. I would say the mass hysteria surrounding many other threads gentle reminders of patience would be helpful.

I think we may have a misunderstanding. I posted that after i saw the post that it took 1200 days for AOS.

the SHUT UP was for all of the newbies who come and start out, its been two weeks (Exaggerating) and i don't have my green card yet.

I believe that everyone checks all of the threads.

Would my post be more relevant to the CSC Thread, yea, probably, but it was in response to the 1200 day thing.

I got two letters in the mail--one for a fingerprint appointment, another for an INS appointment scheduled for the next week. They said just to bring my passport. So on the appointed day, I make my way though the snow-and-hail storm to the fingerprint place, then to the INS, but lo and behold, the immigration officer who I'm supposed to see hasn't come in. So I trek home.

A week later I'm back. My case worker comes out, she tells me the name check came through and I would probably be approved "soon".

"Soon? What's 'soon'?" I ask. She looks at me. She knows I've been waiting for years. So she says, "Do you have half an hour?"

I hand over my passport and sit in the waiting room.

Half an hour passes. She comes back. There's a new stamp in my passport. I've been approved.

Two weeks later, the card comes in the mail.

WOOT! That is awesome news!

Did you have emails saying the card was on its way or did it just - poof! - magically arrive in your mail?

I'm really thrilled to read this! Just wonderful news!

I think we may be getting some goods news soon. I HOPE!

We got an email from our senators office:

The FBI informed me recently that the name check clearance results for

your husband were forwarded to USCIS on December 11, 2006. Please call

me to discuss. (Then she gives the number and time)

We are calling today, I hope this is good news, but I am wondering why our local office hasn't done something by now since this was sent back 3 months ago? One good thing is that the senators office can get more information with the local office were as they couldn't move the FBI.

I know so many of us are reluctant to rock any boats, but on another site I belong to, they have provided an operator-assisted comment line in the white house. (202) 456-1111. It is anonymous (she only asked me where I reside). I discussed the points that are of concern to me. I gave the operator the following to take notes on :

  • family unification should be a priority

  • we need a mechanism to hold USCIS/FBI accountible for the lengthy delays re: the FBI namecheck issue

  • lower barriers for waivers that separate families

  • concern for the K2 age out issue - ie: a child can receive a visa up to 20 years and 364 days, but on the next day is deportable

  • i did state the strive act does mirror some of my thinking on the EWI community (ie "z visas" with fines).

I would encourage you, should you want to relay the points you feel are important, to contact them. It only took me about 15 minutes to call and hang up.

so this just goes to tell u that they were probably never were waiting for fbi clearance like everyone is being told. just they are sitting on the file for no reason.

there is also another site i go to and alot of people are still filing the WOM.

UPDATE!!!

We made the drive to Detroit for a 12;30 PM infopass appt yesterday. Went through the guards and metal detectors (why is everyone so stern, unfriendly, and miserable looking??) Got there half an hour early and there was only one couple waiting. Two people came in without appts and were minimally helped by the receptionist. By the nature of their questions, you could tell those were virtually clueless...definitely not reading visajourney message boards :)

We got called up to the window within 5 minutes. So far so good!

The lady behind the counter seemed to keep the hairs on her neck in a constant state of arousal, so she her initial response to us was...

what you doin here...you wastin your time makin a trip here...there is nutin we can do to speed up this process...the delays are not the fault of USCIS...we have to coordinate with other agencies over which we have no control...your wait time is not out of line...you can't go by that date...OK...what's your A number...no I don't need your son's...he won't get his approval till you get yours....

We cautiously handed over our document and she punched the numbers into the computer. By this time we had humored her and stroked her a bit...enough to let her know we were not there to attack or blame...merely check our status in person to make sure there were no problems mon.

Then nonchalantly, she says...by the way, your name check has came back. We said, no it hasn't. She said yes it has, right here...approved and returned on March 30. YOU ARE NOT KIDDING...WOW...needless to say we were elated and dancing and even got a smile from the lady behind the counter. I suspect not many smiles in that office on any given day.

She said it has to go across the street for processing, but look for something in the mail within 30 days. UNBELIEVABLE!! Seems I remember someone a couple years ago telling us it should only take a few weeks...

But regardless...we breath a sigh of relief and dance on out of there. On the way out Laura points to her lips and says to the guards...see this...this is a smile...we are leaving here happy. All three of the men had a good chuckle over that one.

It just so happens that a month ago, Laura had refiled for travel documents. She thinks that shook the bush in Missouri and someone found our file sitting there ready to move on. But it isn't USCIS's fault for the delays...no sir...

So they got another $340 out of us. :wacko:

And as the lady behind the counter said...

trust me on this one...you probably won't get no money back...we take money...we ain't in the business of givin money back to people...

We said... that's OK...we aren't expecting to get any money back from USCIS...just hoping and praying for a green card.

So while we don't have that slimy little card yet, we are getting closer...so close we can smell it!!

I read that too! I still feel it is so hit and miss. My lawyer has a client who just won a case in Philly but is still reluctant to have us spend lots of money on a case where it is still hit-and-miss.

I have been told to possibly re-file our EAD. What do folks on this board think? I feel like my husband and I have no luck with the refiling thing since we had even re-filed out I-130 and we're still stuck over a year later! We only know the EAD is in secondary review/security checks according to AILA.

I-485 , I-765, I-130: NOA1 : 1/23/2006

Biometrics 2/23/2006

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

zsam, I would probably spend the money to re-file the EAD. At this point, what can it hurt..........

I have to say that reading some of these new developments gives me hope.

Nothing definite to report yet. The lady at the senators office ask us to fax her the letter we got in February saying our case was under review and we should receive and decision in 90 days. Here is a bit of the timeline.

On December 6 2006 the FBI sent USCIS the background results (which we did not know)

On December 22, 2006 we contacted the National Service Center and they put in a request (which says: Type of Service request: Non-delivery) Not sure what that means.

Then a few weeks ago we contacted the senators office as we have been every 6 months. And that puts us to now and she has requested the document from the service center. Hopefully she can get some answers from them. But at least it looks like something is happening, and its odd that Mark and Laura have almost the same timeline as us.

Mark and Laura are you showing any change when you login to the USCIS? Ours still has the March 2, 2005 on it.
