IP,

My interview was on 05/11/06 and I am also pending for the FBI name check. I contacted my Senator at the end of June, the First Lady yesterday and am planning to contact the Ombudsman as soon as the processing date is 30 days over my receipt date...which should be soon. In my opinion if you ask for help sooner rather than later, you might avoid being stuck in the 'black hole' for ridiculous periods of time. It will at least keep your case familiar to everyone important.

WEll I guess this 120 days rule is only apply to naturalization cases. In AOS you can certainly file writ of mandamus to sue uscis, but you can't do so on the basis of 120 days. It has to be on the basis that you have exhausted all of your resources to resolve this matter and suing is the only option left.

Hope this helps

Its been 260 days since our interview!!.

Received another letter today from congressman...same wording the senator gave us....nothing they can do...sent a reprint about namechecks thats on the fbi web site and also from the uscis site.

Lawyer pondered lawsuit and said....do you really want to sue the goverment???...

makes you wonder!

still might try the mandamus; just feeling so exhausted over all of this like somethings got to give........ :(

HUH strange. On what grounds your lawyer said you shouldn't sue USCIS? Filing writ of mandamus seems to be the only solution of this name check pending problem.

14 months since the interview 18 months since Indy sent the request to FBI. The bad part about this other than applying and paying for EAD and AP renewals is it may cost him career wise because he does not have his green card. Pending scares employers.

That's what really worries me. It just looks 'fishy' to people if you don't have your greencard.

We just had our interview. I thought everything was going fine. At the end the officer did not say "you are approved". She said "Your security check is still pending so I cannot do anything with your file; you will get a letter when it is complete" or something to that effect.

a bit different from other information.

Some types of background and security checks return results within a few days and do

not significantly prolong USCIS processing times or hinder backlog reduction goals. However,

while the overall percentage of long-pending cases is small, as of May 2006, USCIS reported

235,802 FBI name checks pending, with approximately 65 percent (153,166) of those cases

pending more than 90 days and approximately 35 percent (82,824) pending more than one year.
