Incorrect resident since date

I think they're taking about six months to process the I-90. I didn't request an expedite with mine and that's how long it took them to reach it and close it out.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

  • 2 months later...

Got my GC last night, just to find out that my Resident Since date was incorrect. It says I am resident since my conditional GC has expired, instead of year 2016, it says 2018.

Fell bit down right now, all this waiting and stress just to find out that still I do not have proper GC in my hand. What's the consensus what is the best way to go around this, I90 processing time between 1.5-11.5 months or to try E-request.

Thanks.

File an I-90 on the basis of a USCIS error. There is no fee. Once you have the I-90 NoA (instant, if you file online) you can then take it to an Infopass appointment at your local office and obtain an I-551 passport stamp, since you will likely need to return the green card with the incorrect date on it.

Thanks, I submitted E-request now and hope they will come back with some quick fix. But I doubt honestly, and most likely will have to fill i90. Thing about it is they don’t even accept infopass appt in Los Angeles anymore, I just checked their web page.

One of the things you can ask for in an e-request in your online USCIS account is help making an Infopass appointment at your local office. It's listed as one of the subjects.

So probably it’s better to submit it via mail and include physical card. do you know if this E-request can help?

Any updates guys? Received the same card error wrong residence since date. IS it better to file online or by mail? IS it true that if I want the fee waived that I must file by mail? Thanks for the help as this is very frustrating.

I cannot say whether it is better to do this via mail or online but to be safe I would do it by mail so they have the actual greencard in hand I believe that is what was wrong the first time I did it. Also when I sent this in I sent the I90 and checked 'USCIS Mistake' so the fee was waived. When I called USCIS they also explained to me to send the greencard.

I just keep getting updates via email saying: ..

WOW. I talked to a member here earlier who had an error on his GC as well (wrong dates I believe). He told me that he didn't file an I-90 but instead did an E-Request on the Uscis website. They have a special section that say typographical error and you can submit a service request by explaining what was wrong on the card and what should be the correct info. He told me he got an email from USCIS within two days giving him instructions on how to return the "wrong GC" . He said three weeks later his new card was being produced. So idk. I did an E-Request earlier today. I called USCIS three different times today and of course I got three different answers on what I should do. I requested an infopass appointment so I can go and get the I-551 stamped in my passport. If I don't hear from the service request in a month (They say it can take 30 days to receive and answer, SMH) I will go ahead and do the I-90. Will probably do it by mail. Did anybody have problems with work with this error? I haven't started working yet but I am unsure if I can even present this GC to an Employer with this error.

As long as you have your i551 in your passport when your greencard is invalid you can still work. I even went home without a greencard twice without a problem. I suppose it depends on which officer you get and maybe the greencard, was he a conditional resident as well??

It was a 10 year GC. Hopefully I get a quick response from them, I thought I was done until Removal of Conditions but I guess they had other plans for me lol do you mind if I send you a PM?
