I am the US citizen petitioner living abroad with my spouse (beneficiary). I have been unemployed for the past years because I was a student and currently mom/housewife. Because of this I have never filed taxes. My husband is the owner of a business here (mini mart/grocery store), and that income will continue even after we move to the United States. We have 3 person household size.

I have recently signed an employment contract for a job offer in the United States (medical residency in pediatrics) with an annual salary of approximately $56,000. This job doesn't begin until July 1st. 

My question is whether I can use my spouse's foreign earned income to meet the income requirement, and what evidence would I use to prove his income? The evidence I was thinking of: business license, bank statements for the past year. 

Any advice would be greatly appreciated!

This was answered here before and you may be able to find the site or someone may rembember but yes,  i did find case where you can use foreign spouse's assests for this (USCIS site but could not find it just now)   so research it (may be under assests not income)

but as his spouse half that income was yours and you should have been filing US taxes (it is well over $100,000 that is exempt) 

you could have filed claiming him and your child
