Our attorney said it’s fine but we are afraid if it might affect our I 601 and I 130 Waiver. I’m already at my home country in Japan (used to stay in the US) but want to study in UK. Can my husband get work permit in UK and work there while he’s visiting me there for 5 months?

There’s no waiver for I-130.

What do you need I-601 waiver for?

Need to see how/if husband qualifies for UK visa on British immigration forum.

We are first doing I 130 and then next is I 601 Waiver

Is it because it would be taking a risk on our case?

While it appears that it is easier to get a work permit in the UK, they still don't hand them out like candy.

Does he have an employer sponsor?

YMMV

No but since we’re working on extreme hardship waiver, would that affect our case? We are worried

That my husband would suffer without be being there with him basically.

I am not going to pry but if you are saying that the hardship is essentially because of separation from each other, then I wish you luck, because if that is it, then you are not likely to prevail in your waiver request.

YMMV
