Filling out my wife's AOS and we're on the i-765.

 

What do we put for Question 20 which is the eligibility category.

 

I've researched and a lot of K1 holders put (A)(6) but I looked up the instructions and it states that you put that for k1 holders if you are applying within 90 days from date of entry. My wife is over the 90 days now, shes basically on day 106.

C9 Pending Adjustment of Status. It's irrelevant what visa she entered on, she is applying for an EAD based on the AOS application.

 

A6 is currently completely useless. In theory, someone who enters on a K-1 can file for an EAD on the day they entered, using A6. But the EAD would only be valid for the 90 days past POE. And it takes 90 days to get the EAD, so by the time they'd receive it, it would not be valid anymore.

So C9 is satisfactory?

 

btw. We have her SS and there is an employer willing to hire my wife already and says its okay that she doesnt have her EAD yet.

I'm kind of skeptical about taking that offer for my wife because we havent even applied for her AOS yet.

 

If she were to take the offer and start working, what will happen?

Then she would be illegally working and the employer would get a hefty fine if discovered.
File AOS, category C9, EAD can take 5-6 months currently for many.
If she wanted to work when she arrived then you should have married filed for a CR1.
Accept that she can not work legally and that it will take several months to get the EAD approved.
Why wait to file and drag it out.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
