Document for arrest

Hello,

           I need an urgent advice. I have my citizenship interview within a month. I was arrested at home country for the political reason for less than 24 hours and was released without any charges. The interview letter asks me the following question.

-If you have ever been arrested or detained by any law enforcement officer for any reason and no charges were filed, bring an official, certified statement from the arresting agency or applicable court indicating that no charges were filed.

Now I know the police will never give me that statement that they arrested me without any charges. I am thinking of getting an official police clearance certificate that will say that " Since my birth to the last date when I left my home country, no charges are against me" Will that statement be sufficient? 

Does anyone have similar situation?

Please advice

Give them what they ask for. No more no less. You’re just asking for trouble if you don’t.

That would just cover any charges/arrest warrants that were still *open* to date....not arrests/charges that happened before and were already dealt with.

 

USCIS will want to see an official arrest report/court-sealed statement that there have been no charges against you in the past.

Thank you for your prompt reply. Well, I was arrested for political harassment and they never filed any charges against me. Neither police nor the court is going to create a statement that I was illegally arrested without charges. I am confused.

The court can issue a sealed letter that you have no outstanding charges/convictions/fines.  The police can issue a sealed letter that any written arrest reports have been purged/destroyed (depending on how long ago the incident occurred) and there are no outstanding charges/no outstanding warrant for your arrest.

 

I assume you disclosed the arrest on your N400 application....by doing so, you now have to give USCIS the documents required related to the arrest.   You can try with just the police clearance letter, but be aware the IO may not deem it sufficient enough, it's up to them.

 

What did you submit to them when doing your AOS/ROC?  Or did this happen more recently?

Thank you. This forum is great. Yes, I did disclose this information on my N-400 form. The interview letter contains a second letter with a printed list of item to bring at the interview. One of them is an official statement from arresting agency or court to state that they are no charges against me. I can request the arresting agency to issue a letter stating that there are no current or prior charges against me.
