My wife entered the US on a visa when she was 5 and left 5 months after turning 18. She has been in Mexico for 6 years now. We have our interview this month and I need to know do we need a waiver of forgiveness? Please help.

No

IF you do end up needing a waiver, please realize that it can take 6-9 months for approval.....( my wife's took 8 months)

She may need a waiver because she over stayed her visa and violated the visa agreement.... She came in at 5yrs old and left the U.S after turning 18yrs, so she was here illegally for at least 12years. If she does need one she will be told at the embassy.

She didn't end up needing one because she was under 18 years old. No time unlawfully present under the age of 18 is counted as well as 6 months after your turn 18. Also since she was in Mexico for 6 years any bar against here would no longer exist. She was approved this week thankfully!
