Waiting time for confirmation of receipt

Hi,

 

I am new here and I wanted to inquire some things. We submitted our I-130 packet last Feb 2, 2018 (date it was delivered in Chicago). I am reading that it will take days before we receive a text message or email from USCIS that they have our package. But a colleague told me that it will take up to 90 days before we hear from them. So my question is, is it okay to stay even my visa (am on tourist visa) will be expired soon?

Stop listening to your colleague.  You should receive your I-797c in about 2 weeks via the USPS

Thank you for your reply. If in case, I don't get anything after 2 weeks, am i still legal to stay even if the cofirmation hasn't arrive yet?

But will my status then be illegal? Will I be tagged as overstaying?

You are OK.  Overstay days do not accrue while an AOS application is pending.  Your I-797c is however an important document to have because it is proof of the filing

Okay. I got that. But... If and only if we don't receive any i-797c after two weeks, what will happen to me?

Nobody will come looking for you...  Unless you find yourself in trouble with the law

You are asking on the family of Permanent Resident section of the forum. If your spouse is a Permanent Resident you can not file the i-130 package together nor stay on the country, you would be overstaying. Unless your spouse is a US Citizen.

 

In that case, you have to receive a digital notification. And later the notice of action.

It has been two weeks and there is nothing in the mail. We are getting anxious. Is it wise to call uscis? Thank you!

Her asawa is a PR not a USC so she can not just stay and adjust status.
