AOS time ?

Hi guys,

F1 student here and me and my fiancee are getting married in may and going to file for my AOS/i130 ASAP. I am supposed to leave the US 60 days after my last class which is in October. Just curious how long does it usually take for USCIS to get the paper work to start the process. I understand that once the paperwork has started I can remain in the Us even if my time has expired in October. Just making sure that the 5 month window I have will be sufficient. Also has anybody done AOS from f1 in Texas? If so how long did it take and what office processed it.

Once you successfully file, you're fine since it grants authorized stay. It may take them a week to a month to send the NOA1 to acknowledge it so you have proof of filing / authorized stay, but you're covered once they accept the filing. Secondly, marriage to a USC means any overstay is ignored for AOS purposes. A five month window far more than sufficient to get the NOA1.

 

Most AOS applications are taking 8-12 months, but do vary heavily from office to office and case to case. There is more than 1 field office in Texas.

I am close to basically San Antonio , Houston and the Harlingen Office. In the middle of them all. Do I get to choose which office I file at? Harlingen seems to Have the least amount of time to process! Also after filing how long does it approx take to get a work card ?

No, your office is determined by your physical address. See the first link I posted above to determine what office covers your area.

 

You send the forms to an address in accordance with the rules defined by USCIS: https://www.uscis.gov/i-485-addresses. Once filed, they will direct the applications to the correct areas for processing.

The EAD (and AP) are usually processed at the National Benefits Center (NBC). ETA: ~4 months.
