Question about current edition of USCIS Forms

Hello.

 

I am filing my wife's AOS Application today.  As one of my last checks before sending the package off, I confirmed on the USCIS website that the forms I am using are still current forms.  What I found is that one of the forms, the "I-765 Application for Employment Authorization" has been updated.  The USCIS website reads:

 

07/17/17. Starting 12/04/2017, we will only accept the 07/17/17 edition. Until then, you can use the 01/17/17 edition. You can find the edition date at the bottom of the page on the form and instructions.

 

Right now I am using the 01/17/17 edition of the form.  They must of uploaded the new form edition to the website within the past 3 weeks because I downloaded these forms 3 weeks ago.

 

Anyway, my question is... it says I can still use the 01/17/17 form until 12/04/17.  So does that mean as long as they receive it before 12/04 I am safe?  If they review my application AFTER 12/04 will they still return the forms?  Even though they will receive it tomorrow 11/06?

To be on the safe side I would use the new version of the form. Then there will be no question due to the older form. You might be ok but if not then you will have a delay.

As long as your application is filed before that date, it should be accepted.

 

That said, they have made mistakes during the last days of these overlap periods and rejected properly filed forms due to having the old version (it happens...these are human processes). So if you can do the newer version of the form, that would be optimal.

I filed it this morning.  Sent it overnight delivery.  Will be at USCIS tomorrow before 3pm.

 

I kept the I-765 form as is.  Since it said on the website it still can be used.  Hopefully I don't receive any issues.

Overnight is probably overkill. But it's fine too.

 

I don't anticipate any issues. The issue usually comes in for people who filed before the cutoff but they don't put it into the system until afterwards. Once they accept the filing, they won't reject it later for having an old form.

I sent it overnight because our I-94 expiration date is Nov. 12th.  I didn't want it to arrive too close to that date.  I know that is just a deadline for marrying.  But I've read it's best to make every effort to file before that I-94 date, so that's what my goal was.

 

So yes, hopefully no issues with form.  Since it's still good till December 4th.

 

My only problem now, a self inflicted problem, is I "assumed" overnight shipping with Fed Ex would come standard with tracking.  Well... it didn't!!!  So, I have an overnight package, with very very valuable information and intent, being shipped without tracking.  I didn't notice till I looked at the receiipt later.  Ahhhhhhhhhhh........   That makes me so mad
