Need help regarding taxes - URGENT!!!!!

Ok so our accountant messed up my husband's taxes a while back putting him as single when we wanted to file married filing separately. His taxes have been since fixed.....My question is, what am I sending into USCIS? Do I send his 1040 original tax return that says single, plus his amended 1040 tax return plus his account transcript which reflects the amended status married filing separate? I wrote an explanation letter explaining why his tax returns say single in the first place and that they were amended etc. I just don't want to send them more info than I need to. Can someone please help? Really want to send out my package tomorrow. @CookieCat

 I would send the 1040, 1040x, and the transcript so you can give them a paper trail. Plus include as short and basic as possible explanation from you as to how this happened and why. If anything, I would be trying to get a statement from the accountant saying he or she goofed the status if able and keep it in your documents to bring to interview day. Goodluck!

Does everyone have an interview? Or is it a case by case basis? Also for our joint tax returns the prior year should I send in the full tax return 1040 plus the account and tax return transcripts? A lot of people have told me to just send in transcripts and thats it, don't want to get an RFE

I think ROC is about 50-50 for interviews. I only sent transcripts for our entire process, lawyer told us that they are the gold standard compared to 1040 forms.

Ok in that case, I will only send the 1040 for my husbands taxes this year like you said a paper trail is good, and then I will send transcripts for my tax return for this year and transcripts for our jointly filed taxes last year.

But this is for immigration purposes....not tax/benefits purposes. 

I would send them the amended return showing you are married  (filing jointly or separately).

Ok so you are saying not to send the original 1040 tax return for my husband at all?

I agree with what @CookieCat said. Including the original tax transcript and the amended return with a short explanation of the error should be sufficient.

Thanks @CookieCat I actually wrote an explanation letter that I will put in just before my husbands taxes that I signed and dated. Thanks for all your help!

You do know that tax returns are not a required document for the I-751, right?

 

 

If it is imperative you file the 751 today and aren't sure, then send without. You could always submit them at a later date if you choose to.
