Hi all, I'm a k1 visa holder and we are going to apply for AOS. For the marriage certificate apostilles, my friend told me we have to go to the State of Texas department of apostille instead San Antonio department of apostille. Otherwise, we will receive RFE. She said her friend received RFE because of that. But my husband doesn't agree with that,so we argued about it😔

Anybody knows about this too?

Thank you very much!

I believe you should be contacting the issuing county clerk office for a certified copy or your marriage license. Not sure why your friend is telling you otherwise.

For my I-129F, K-1, AOS, EAD, AP and ROC detailed timelines, please refer to my timeline page :)

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

My sincerest gratitude to all VJers, especially the late geowrian.

I got married in Austin, Tx in December. We didn't have to go to San Antonio for any documentation. A few days after our wedding we went to the county clerk's office where our marriage license was issued and bought a few certified copies of our marriage certificate. I think the first one was even free. That's what we sent off and we didn't get an RFE.

we live in San Antonio but my friend told me to go to Austin, because the States of Texas department of Apostille is in Austin. So if we have to go the States apostille  office instead city apostille in San Antonio?

If you got married in the US and you are adjusting status in the US, you don't need an apostille at all. You need your marriage certificate, which you will get from your county or city office.
