The provision in the LIFE Act of 2000 that created the K3 has not been repealed; because of that, USCIS personnel, their contracted call-takers, and the website itself will show the K3 as a viable option even though current procedures and practices have rendered a K3 almost unobtainable.

Thanks, I am aware that it is technically still on the books and available. What I don't get is why, if they were being so "helpful", they would have only presented the op with the k3. Plus, from everything that I have heard about and experienced with uscis, I'm just surprised they were taking so many steps to help op (giving all kinds of forms, etc.). I realize they do have to make the forms available, just seems way more helpful than what I've ever heard/seen from the uscis. That's why I was wondering if it might actually be some sort of consulting company (like rapid visa, etc).

OP, when completing the I-130 you still need to state the interview location (which the consulate n the country where your husband lives or the one that his country uses if it

While stating the interview location is correct, the act if indicating the current address of the beneficiary is outside the US, once the case gets to NVC, they'll go ahead and assign it to the correct Consulate, no matter which city and country you entered on the I-130.  For example, for China, many who don't understand that all immigrant visa interviews occur in Guangzhou, might enter Beijing, the case will still be sent to Guangzhou.  With the exception of India, there is only one or zero Consular IV units in any give country.

The exception is that Iranian residents can choose between Ankara and Abu Dhabi, as there is no Embassy, much less a Consular Immigrant Visa unit in Iran.  There are now two instead of three in India.  Only one anywhere else.

Facts are cheap...knowing how to use them is precious...

Ill be going to the USCIS on Thursday. I will keep in touch with everyone here to let you know what it is that they told me. The day after I will be sending out the I-130 and all that needs to go with it. Im questioning why it that they did that as well. So we will see if this time around they treat me the same way they did last time. Except this time I know more of what to ask. Ill keep you all updated.

Why are you going to the USCIS office? Your case is very straightforward and no different from ours or many others on this site. For a straightforward case there should be no need to go to USCIS offices. Just complete the I-130, the I-130A and the G-1145 (optional, but useful) and send to the relevant lock box for your state of residence. Hundreds of us go through this procedure every year and don't need to go to USCIS offices. It's actually quite a simple procedure, I think. Looking back on it, it was slow, tedious, frustrating because of the wait but certainly not complicated or difficult. None of the forms asks you a question you don't already know the answer to.

Good luck. Now prepare yourself mentally for the wait. So you ended up just submitting the I-130 for the cr1/ir1, or did you decide to try for the k-3?

So I ended up scheduling an appt with an immigration lawyer, who was super awesome in answering my questions and she told me the same thing about the k3. So I am not gonna do the K3. I am gonna wait patiently for the cr-1/ir-1 to go through. I really wish there was a way to expedite this or push it along some way but there isnt. (Unless you know a trick hehehe)

I am not able to leave to visit him because im in a program at school until december of next year 2018.

Everyone wants that. If there was then everyone would be doing it. The good thing is that the program may keep you busy and help distract you from the waiting.
