need help

 

I am a US citizen and got married in the philippines in 2002. We dont talk anymore since 2008 and i filed a divorce 2016 here in US. I found a girl who is not married in the philippines I want to marry her. weve been communicating for 5yrs and see each other when we take vacation together. can i file for a fiancee visa for her to come to US. will this cause problems for me filling a fiancee visa

My guess is you will just need to show your executed divorce documents just like a lot of us.  Since you are not a Phil citizen, you will not need a CENOMAR but your future asawa will.  That is an interesting question.  My guess is you are good to go as long as you can prove you are eligible to marry.

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Once you have the final divorce decree and are therefore free to marry, you can file the I-129F for your fiancee. That said, be sure she knows of your past marriage....they may ask her about it during the interview. Normally a short period between a divorce and (planned) re-marriage raises concerns, as well as starting a relationship with somebody else while still legally married. But I wouldn't expect too much scrutiny here since you've been separated for so long. Just be sure to provide plenty of relationship evidence.

I see no problems. Complete your divorce. Once you have an divorce decree you are free to file for a fiance visa. You just will not be able to get married there and bring her on a spouse visa. Your divorce would be recognized here but not in the Philippines (well it could be but it would take quite a while). That is something to consider when it comes to your future wife and her ability to do an ROM. You would need to have your previous divorce recognized in the Philippines first.

You are good to go!!!   Can't marry in the Philippines but for the rest of the world you are golden.    :thumbs:
