Pending Change of Status from H4 to B2

Hi Everyone,

 

I am currently waiting for the result of my application for change of status from H4 to B2. I filed my application before my H4 visa expired in February 4, 2017. My application is going to turn 6 months this August. Do I need to file for an extension knowing that the maximum they can give me for B2 is 6 months or do I just wait for the result to come out? Will I be able to change status even if my B2 result has not been approved and my previous status is expired? Thank you in advance for all your help.

If you've been waiting for your application for 6 months and your H1B/H4 ended in January, maybe you should leave. You'll probably not get the visitor visa/permission by this point and you can get in trouble. You've already stayed a long time. You cannot apply for an extension of the visitor visa if they haven't even decided on the original visitor visa/petition.

 

You can try to call USCIS to make inquiries if you want. But I think you should prepare to leave.

Would you know if there's any update on why it's taking too long for the decision to come out?

keep in mind that the h4 did allow you to work and go to school. the b1 does not hence you were no longer allowed to do those things even with the pending change in status. and working or going to school will give the impression of living here not visiting. regardless of your petition the b1 you could potentially get would be up on August 4 so it would be best to leave by then since that was what you asked for anyways.

You know the max you can get on a B2 is 6 months, which is in August.

 

So are you not already planning on leaving before those 6 months are up, regardless of the result?

 

If not, begs the question what exactly are you doing in the US so long and why?

How long did you apply to stay. I agree with the others 6 months was the max so when are you leaving?
