Affidavit of support - Is joint income with prior spouse acceptable?

Hi all

 

We're currently waiting on our NOA2 but we've been looking ahead at the required documents for the K1 visa interview.

 

One is obviously the Affidavit of support and we are required to prove that my fiancee earns > $20k per year.

 

The last tax return she filed (Dec 16) was filed with her previous spouse (she got divorced in Mar 17). As such her income tax return only shows the total amount they earned and does not separate the income (the total far exceeds the $20k requirement).

 

Are we able to use this therefore as support for her sponsoring me or would we need something else to show her solo income?

It should be the current income for you fiance. She could ask the place she works at to provide a letter for her current income and send some paystubs too.

Not sure how fast your service center is working right now. She might be doing 2017 taxes by the time you get your interview and she can also use an employment letter and pay stubs to show current income.

For the I-134, she may be asked to show her most recent tax return (transcript preferred) so that should be provided anyway. But even with that, she should provide a letter from her employer and at least several pay stubs to show current income.

Also - she is self employed so doesn't have a letter from employer/pay stubs. She earns cash so the tax return is the only form of proof, and as I stated her latest tax return also included her ex-husbands income
