I'm getting ready to send off for AOS and my co-sponsor sent all the paperwork but upon closer inspection she only has her tax Return Transcript from 2013 and then a Wage and Income Transcript from 2014 and 2015 but I know they want the Return Transcript for at least 2016. I told her this and she said that she hasn't filed for the last 3 years and she said there was an issue with her company and the payroll taxes and there were multiple other issues. I know it states that if you didn't file you need to provide an explanation as to why (this sounds like a very good explanation because it's beyond her control and not her error). What should I do? I have proof of income via an employment letter with the salary stated, 6 months of paystubs, and W2's for the last 2 years so I have proof that there is income. Just not proof from taxes. I don't want to get an RFE but then again there's a chance I might not. Is it better to send what I have and risk getting an RFE or to wait until I have those transcripts to send off for AOS? I don't know how long it will take her to do her taxes and we're wanting to start this process so she can work and travel if needed. Random question: Is there a time frame you have to start AOS?

Maybe find another sponsor.

 

They will ask for the tax returns and if she does not have them it will be a mess. Does she have something from the IRS as a receipt of this mess? 

 

There is no time frame for AOS but you won't be able to work or do almost anything (like getting a drivers license) if you don't AOS. It will also delay your green card, ROC, and it will push forward the date for naturalization. In an ideal world is fine but if you are somewhat risk averse it would be better to find another sponsor and get it over with.

Notifying the IRS about whatever reason she didn't file was NOT out of her control. Something doesn't smell right to me. The IRS would swiftly come down on a company that prevented employees from filing taxes. Not buying her story.

 

The trouble with W-2's or paystubs is a person could work two jobs but only give you the paystubs or W-2's for one of them. Tax forms see all their work.

The only thing she sent from the IRS was the Wage and Income Transcript. The other option would be for me to get another job and hope that I make the minimum but I'm doubful that will happen. I'm a college student so getting that many hours on top of school is hard :( I don't know of anyone else that would co-sponsor for me

I know. I'm going to see if she thinks she'll be able to get her taxes done and if not I'll cast out a net for help and see if I have anyone willing and go from there. Thanks for your input :)
