Hello All,
I am US citizen by parents but I have never been to the US before, Just got the citizenship from the embassy
now I am living in UAE with my husband and I want to file form i-130 for him so we can travel togeather
my question is am I eligible to do so or I must have been there before to do this.
and if I am eligible to do this form must I send it by myself from UAE, or can give all the papers, documents and fees to my brother in the US and send it for me.
the last question for the affidavit of support  can my brother be the sponsor as I am not working

Your Brother can be a joint sponsor but you will need a US Domicile, Tax records etc.

You have to be actually residing in the US to be able to sponsor someone into the US.  They will ask for proof of residency (US State ID or US drivers licence, US tax statements, US utility bills, US bank statements among other things).

 

Part of being a sponsor is being able to prove that you can financially support the applicant.  So, in your case, without employment it would be quite difficult to prove that unless you can prove that your brother has the financial means to support him. 

 

As far as your brother goes, he can be a co-sponsor, yes, but the main thing is that you are not residing in the US, and have never resided in the US as you stated above.  They wouldn't approve your application unless you are.

You have to show US Domicile not Residence to sponsor.

I don't have any  US Domicile  
I just have US passport and a social security number and these are not enough.
I think that I have no option than going to the US and have a place and work then start the form i-130 file for my husband.
Anyway, Thanks for the info :)

The requirement vary by Consulate but there can be times when a spouse has to lead the way. With a job you can be the Sponsor without need for help.
