They may have refused the visa under 214b, but that doesn't necessarily mean they didn't determine a finding of fraud either. All you can do now is apply for the visa and find out. Be sure to be truthful with all questions and documents moving forward - don't try to make anything "sync up" with a past lie.

I have already aplied for an immigrant visa but dont know if i should just be truthful about and is it ever possible not to be asked about it?

Always be 100% truthful with immigration on any documents, forms, or people.

It's possible to not be asked about it by the CO, but it's possible that you will be asked about it.

I have seen many cases where it seemed just one was used where it was reasonably clear many others were present.

It is always possible that a) the officer missed an ineligibility, b) a poster did not provide all information in this forum about his/her ineligibilities, or c) what seemed reasonably clear based on the information available here was not as clear when all the information about the case was viewed by the officer.  I have seen, for example, that people are quick to say something is fraud or misrepresentation here in a forum post when it is pretty clear that it would never rise to that that level when the consular officer adjudicated it under all of the requirements for a finding like that.

It may well vary by Consulate, the ones where it seemed to happen a lot were Mexico and to the south. Seen a few cases where somebody was 9C and was refused a non immigrant visa, now that of course could be waived for a non immigrant.

9C is waiverable after the person has been outside the US for 10 years; before that, no waiver is possible -- but all this is irrelevant to the OP''s question.
