We went through Rapid Visa and finally they have mailed the K-1 package to USCIS. So now I am getting ready for the next step and I have found conflicting information.

 

* I read (I don't even remember which thread) that Manila wants 125% level for the AoS

* RV is stating that Manila will not accept joint sponsors or assets

 

My search-fu sucks on here because I don't have a good handle on the jargon, and I've scanned through the past few months threads in the Philippines forums.

 

Can someone point me to the definitive answers? I hate to fall a few hundred dollars short of bringing my fiancé and her children here.

Manila sometimes wants 125%. The technical requirement is 100,but they can basically do what they want. It seems to be rare to have the 125 %. However, you know you have to be at 125 percent for AOS right? 

 

Manila doesn't generally accept cosponsors on k1 applications. Exceptions are sometimes made, as always,  it depends. 

 

My fiance got her visa recently and they didn't even ask for the affidavit of support at all. They requested no financial documentation. She's from the Philippines too, so it always just depends.

Yes, the 125% shouldn't be a problem if I can use assets and/or co-sponsors.  Like I said, I am only a few hundred off the 125% so my next COLA might fix that.

I wouldn't sweat it too much. How long were you in the Philippines? Because the reason they didn't question my fiance so much is because I was there almost 6 months. 

 

They asked her about my work and she told them all about it and why I stayed so long and they laughed and he said approved. So, length of stay seems to help.

Ok, they will probably ask why you didn't stay longer just be prepared for that. A week should be fine, the technical requirement is meeting within 2 years. However, some people only meet for a day or two and get denied, because it's obviously suspicious.

 

I sweated everything so much and it ended up not being an issue at all.

Oh I definitely understand that. I intended to stay 2 weeks and stayed a lot longer. 

 

You'll get through it just try to be patient. (I know that's obviously easier said than done lol)

Read the Embassy letter and use for a reference to be prepared and to double check RV. I hate that you hired anyone as there are so many here that will help you.

For the past two years USEM hasn't been asking for financials BUT in the Embassy letter it states be prepared as it maybe asked for. Not having it will cause a 221g and a delay of the approval of your visa.

 

One week visitation WILL NOT cause a disapproval.

I-129F package* (K-1 is later)

 

USEM COs usually don't ask for the I-134 or evidence, but it is still listed as a document for the interview and they can still ask for it, so you should have it ready to show just in case. If they do ask for it, they usually look for the 125% level, and accept joint sponsors only on a case by case basis (usually close family members can be accepted).

Using joint sponsors won't impact the 125% level - a joint sponsor needs to qualify separately...you can't combine incomes for the I-134.

Using joint sponsors won't impact the 125% level - a joint sponsor needs to qualify separately...you can't combine incomes for the I-134. My cosponsor (if needed) is a sibling and exceeds the needed income

Thanks for all the support.  I guess I'm not the first that started second-guessing everything.

Nope you aren't the first one as I have seen many. Funny thing is all the worrying an anxiousness causes one to second guess the process. Lot of misinformation given. Its usually the Pinay who sweats the small stuff and has doubts. If after you answer their question they are apt to ask you again. By the way she is going to be in front of the CO for 5 minutes tops.

Manila does expect you to meet the 125% guidle lines (you will have to meet that number once in the USA for AOS anyway), even though on DOS it states 100%.

 

(with that said, since 2014 USEM has not always been asking for support evidence during the interview... not something to gamble on, just making note)

 

RV is wrong.  Co-sponsors with the K-1 are accepted on a case by case basis, USEM looks for the co-sponsor to be a close family member; parents, siblings.

 

There is NOTHING in writing anywhere on the USEM webstie stating the 125% ... I know for fact as many before you have reported back on this to be fact, some of which are friends of mine.   (trust me - I'm with the Gubermint ;) )
