Hi All,

 

I am currently on F1-OPT status. Before applying for AOS, I tried changing my maiden name to my married name several times at different SSA offices. I was told that something was off in the system by the department of homeland security so eventually I gave up. I filed all of my applications (AOS) using my married name. Now all of my US legal documents documents (lease agreement, current EAD, and driver's license) use my maiden name. Only my UK passport and my I-797 actually recognize me by my married name.

 

Questions:

1. I need to renew my license based on my I-797. Will I have a problem since my current license uses a different name from that on my I-797?

2. If I go back to SSA, do you think I'll be able to finally officially change my name since I now have an alien registration number recognizing me by my married name?

My experience has been that they will issue your SSN only in the name found in the SAVE database that comes from USCIS/Homeland reflecting your immigration status. Right now that is the name on your EAD (your most recent immigration status). If you get a greencard issued in your married name, then SSA will find you in the database  and issue your SS card to match. Give it about 10 days to populate the database after any immigration status change.

You said your EAD is in your maiden name. You likely aren't going to get anything changed from that maiden name (including driver license) until USCIS issues you a new status (permanent resident) in the married name and the Social Security office and driver license office find you in the database populated by USCIS. They will not change it by seeing an I-797, or a greencard, or a naturalization certificate. They must find your married name in the computer.  Wait for your greencard and hope it is in the married name.

My application uses my married name so I am assuming that the new EAD/AP will use my married name. I'll maybe wait until that gets approved before lining up at SSA again. Thanks!

The application name doesn't count. Until something is approved, issued, in your hand, and updated in the SAVE database you might as well wait.
