Work visa while waiting for Husband visa ?

Hi everyone, 

 

Quick question. End of last year, my wife and I applied for a CR 1 visa following our marriage in the US. As of today, the process is still ongoing (still on Phase 1, no news) and in the mean time, I received a job offer from my current company (french company with offices in the US). My question is: is there any problem to accept the offer and get a work visa (not like normal work visa, because it's considered as an internal transfer within the Company), while waiting for the husband visa in the same time ?

Assume this is a L1, move and then adjust in the US.

You're good to go, I'm not sure what the company will need to do internally for you to remain employed once you're residency visa is approved, though? There's also a good chance you will need to return to France at some point to complete your visa interview. I was unable to have my medical exam or interview conducted at a office in the USA. Good luck!

Hi everyone,

 

Quick update and a question to be sure I'm going through the right process.

 

As explained previously, end of last year we applied for a CR1 visa (Spouse) as my wife is American and I was living in France. In the meantime, I received a work visa (E2) from my employee and I am now living in the US under this visa.

Last week, I received the notice of action I-797 telling us that the petition was approved and sent to the USCIS. The next step being to make appointments to continue the process. As I'm not living in France anymore but in the US, what should be my next step ?

 

From what I understand, i should contact the NVC in France that I won't continue the process and, in the mean time, apply for an adjustment of status (I-485), is that correct ? If so, will I end up with the spouse visa or directly with a green card ? And do you know how long is the process usually ?

 

I just want to be sure that I'm not messing up somewhere and lose the 9 months we have been waiting for the first approval of the CR1.

I assume you want to adjust in country rather than do consular processing.
