Hi!!

 

My first question is:

Are this letters "Request for Initial Evidence" generic? 

Im applying for my dad, with a join sponsor because i don't meet the 125% of the poverty line, 

He received the letter listing 3 things, but the 2 of them doesn't seem to make sense, at least i can't understand em even after i called customer service, they didn't help me.

 

One of the points says: 

"Form i864 (affidavit) was submitted from a joint sponsor, however the names listed in page 1 and page 3 aren't the same"

The name of the sponsor only appears on page 3, no other time, so how can this be?

 

and the second point says:

"... the join sponsor did not meet 125% of the poverty line guideline for the household"

which is $25,525 for a 3 person household (sponsor, sponsors wife and my dad) the sponsors makes $32,000 a year. every year.

 

Im very concern since the letter says " submit all of the information requested below at one time, failure to do so will result in denial" 

After spending so much money!

Usually when there's something wrong with the affidavit they automatically add that the person doesn't meet the poverty limit, so if you're sure he does meet the limit then don't pay pay attention to that. Just fix the rest of the issues.

Usually when there's something wrong with the affidavit they automatically add that the person doesn't meet the poverty limit, so if you're sure he does meet the limit then don't pay pay attention to that. Just fix the rest of the issues.

Thats what i was thinking, but every time that i read the letter again it makes me nervous to mess it up.

Are they really support strict about it? do we really only get one chance?

Hard to know, it seems to depend on which person your application ends up with. Some people get RFE after RFE, even regarding the exact same issues, while others only get one chance.

The name of the sponsor only appears on page 3, no other time, so how can this be?

Page 1, Part 1, Question I should be the name of the joint sponsor. Then they would check off box 1.d.

Page 1, Part 2, Question 1 should be the name of the immigrant.

 

Page 3, Part 4, Question 1 should also be the name of the joint sponsor.

 

It sounds like 2 different names were used here...?

If there are issues with the I-864, then they cannot accept it yet and therefore you didn't meet the 125% level. Once you fix the mistakes, they can accept it and therefore take into account the amount of income from the joint sponsor.

 

Be sure to provide a complete I-864 along with all supporting evidence (pay stubs, employment letter, tax transcript(s) OR return(s) + W2(s), etc.).

Failure to adequately respond to an RFE could result in a denial. Always provide complete responses. They do tend to send a second RFE for I-864 issues for AOS, but they are not required to do so. Some may, and others may not.

How much money has been spent has no impact on an immigration process.

Hey I've got the same RFE saying that the names on page 1 and page 3 did not match. I assumed that my joint sponsor used (firstname)(maiden name)(married name) on page 1, and used (firstname)(middlename)(maidenname) on page 3 - so they didn't match. I just made the corrections and resent the form. 

 

Are you sure the names are the same on both pages for yours? If yes, then just resend the same form, they may have made a mistake.
