Hi dear VisaJourney members,

 

I have looked at a lot of topics in this thread and now I'm getting very nervous and scared that we don't have enough evidence. I'm planning to send out the package in 2,5 weeks and maybe I will be able to get some additional evidence in a meantime.

 

Here is what we have so far:

1) Joint tax returns for 2015 & 2016. We have submitted the one for 2014 last time.

2) Both our names are on the lease agreement

3) Both our names are on the financial documents for the car

4) The car is registered on both of us

5) The car insurance for 2 cars states both our names

6) Both our names on renters insurance

7) We used to have a joint bank account, but we moved. I will try to request the statements from our former bank. 

8) I will add my husband to my bank account, we do not have a joint one yet since we moved (October 2016)

9) I have tickets for our trip to Russia in 2015. I guess I will have to translate it

10) I have Greyhound and C&J tickets for the same date with both our names

10) DLs with the same address in NH and our current DLs with the same address in PA

11) We do not have bills under both of our names, but we have bills addressed to either me or him with the same address on it. Also, I can present a copy of the checks from my bank account which shows that I pay a half of the bills.

12) We have photos with our families and friends and some greeting cards

13) I do have a few things which I am not sure about:

- I have a receipt for PS4 which I bought for my hubby as a Christmas present. 

- He might have a receipt from Zales for the jewelry he bought for me as a Christmas present

- He lost his wedding ring at work and I ordered him a new one online, I have a conversation with the seller regarding the size of the ring archived

- I have a couple of confirmations from booking.com which we used to book the hotels for our trips, but it usually states only one name, but a room for 2 people though (and one of those confirmations is in Russian, so I will have to translate it too)

- I have a payment confirmation that I paid the court related fees for my husband about 2 years ago

 

 

I feel like we are going to fail with such a small amount of the evidence.

 

I'm looking forward to hearing your opinion and will highly appreciate hearing about your experience if you had a similar list of evidence.

This looks like a reasonable amount of evidence - do try to track down your old bank statements, and add each other to the accounts you have now. You could add some photos of the two of you if you wanted... 

Also I've heard of some people being asked in an RFE for wills and powers of attorney naming each other. You can create those for free online and sign them and include them.

Put in a cover letter explanations for anything you don't have that you think you "should". 

 

Finally, you won't be denied outright, even if they think you don't have enough evidence. They'll issue an RFE, and then you'll know what they want to see and you can find a way to send it - by then you'll have several months to a year's worth of bank statements from your new joint account, etc, etc. 

Even if they don't see sufficient evidence on paper, they won't likely deny you... they'll call you in for an interview and you can prove your ongoing relationship in person.

 

Only 5% total of all I-751 applications are denied, and many of those are presumably divorce waiver applications. The massive majority of applications are eventually approved, so try not to worry too much.

Thank you so much for responding. I am getting very nervous since it feels like we do not have enough compare to the other people lists. We moved to another state in October and we threw away a lot of old paperwork, which I now think was a very stupid thing to do.

 

Is there some additional evidence you can think about which we can gather in this 2 weeks?

I was thinking since we don't have any bills with both our names on it, should I attach the receipts maybe? I am paying some of the bills, even so, it is under his name. Would this be useful at all?

What about medical/life insurance? I included my retirement document that lists my wife as the beneficiary. If you happen to have any children, include their birth certificate. Honestly, I think you are fine with what you got, but that's just my opinion.
