I485 - Married Name or Maiden Name?

I've asked this before but the forum kinda went astray and the question was not answered with the clarity I wanted,, so now I'm asking again more straightforwardly.

 

My fiance has a SS card with her maiden name on it.  They will not allow her to change the name to her married name until the greencard is issued since the I94 expires this week.

As such we have no documentation that would have her married name on it. (marriage cert, drivers license, ss card, etc)....

 

QUESTION:  Can we / should we - use her married name when applying for AOS -  I485 form.  I am concerned about the discrepancy between the married name and the SS card.  

 

Many people have told me they have used the married name regardless, BUT none of them have actually completed the AOS process so it remains to be seen if it's a problem.

I was in this exact position, ss card  passport and marriage certificate all showed maiden. As I wanted to use my husband last name I put married name on aos  and once I got ead with married name I used it to change ss card to married name 

 

i have completed aos, removal of conditions, and just applied for citizenship all in my married name with no problems. They didn't care that my Ssn had my maiden name initially.

Your marriage certificate is the legal document for your wife that she can use your last name.

Some Social Security offices have no idea how to handle people who applied for their SS Card with their new last name. They told me I had to wait until I have my EAD to change my maiden name to my new last name.

When NOA1 was in the mail, I took all of those and my marriage certificate to the SS office and was able to get the name changed on the card.

 

For her I-485, I-765 and I-131 it's recommended to apply with the new last name. And USCIS will accept the application because of your marriage certificate.

MIDDLE NAME CHANGE:

 

So the general consensus seems to be that she can use her new last name on the I485,,,

BUT

She wants to change her middle name as well.   Maiden name becomes new middle name.   

 

Anybody dealt with that before as well?

Hi,

 

Yes. I changed my middle name. For ex, My name is Stephanie Myers Walters then my husband's last name is Greere so I did changed it to Stephanie Walters Greere. I did that when I applied my AOS and was successful on it until now that I'm applying for ROC. Hope this helps.
