No Driver License until AOS/EAD, but can we take the written exam? (CA)

Hi there.  Title pretty much says it all.  I know my wife can't get a Driver's License until she's got (at least) her EAD.  We've sent in the AOS package, waiting for NOA, fully expect to wait until at least July for EAD... but in the mean time, I'd love it if she could take the written test and get her learner's permit, so I can get her some driving practice between now and then.  Apparently the rules differ from state to state, so I'm curious whether anybody knows the specifics for CA?

Assuming your wife is older than 18, she doesn't need a learner permit and can apply for a DL straight up. But with no EAD, she can't do that.

They do offer Driver Ed course online, but the rule say 18 and older you do not need Driver Ed. You can search around this page or call to ask. I'm not from CA so that's all I can help with.

But this link http://www.dmv.org/ca-california/apply-license.php#Obtain-a-California-Learners-Permit  says there's a written test. I think that's the one for the permit. It's confusing so you have to look around. My best guess is you can do Driver Ed online, then get a certificate from there and get a learner's permit to practice driving. Once her EAD arrives, she can take the road test and get DL. All the info should be there, if not you can call or come to ask the DMV. That's what I did before my EAD come, but I'm from Texas.

Also, I heard from someone that they take receipt of EAD ( they didnt allow this when i went there, they needed the actual card, but that was 1-2 years ago) you can try to ask. Good luck!

Just to inform anyone searching up this thread in the future... we took a chance and went to the DMV this morning.  They were willing to accept our Marriage Certificate (a photocopy) and a Notice of Action from USCIS as her two forms of "proof of address" (they both had her name + our address on them).

 

There was a moment of drama when we realized her I-94 had expired, so they'd need to use the NOA as proof of legal presence in the country.  The lady wasn't sure whether she'd be allowed to use the NOA to serve both functions (proof of address + proof of legal presence), but she went and asked a superior, and got the go-ahead.

 

The written test was passed, pictures were taken, learner's permit acquired.

This works in Texas (I used my i485 NOA1) and some other states, CA is not one of them. OP will need EAD. CA does have another type of License though, that's AB-60 that's valid only in CA and is for ppl who cannot establish legal presence at the time.

I am the OP.  It worked in CA, at least for the learner's permit.  I'm certain it won't get her a license, though, no.

I was referring to getting the license but atleast you got her a permit, that's something :)
