I-130 March 2017 Filers

Anothers questions my wife is abroad, does not work abroad, has never been to the US but i've been reading posts about people having problems filing married separately because they are asked for a ssn or ittn? Itn? Number. Is there a way to not claim her? I feel like doing so would make it more complicated to file.

That's a great question. I have my transcripts for 2014-2016. I would send 2017 only if file before submitting docs to NVC. In regards to filing, I was advised that one could file as married with an ITIN or could file as single and then amend the filing the next year (for the prior year) once spouse is in the US (with SSN during the filing season).

well that depends. when you put that you are married on the form are they going to assume you name has changed? if they don't assume that it has changed then go ahead and put your spouse information and request the report. its a weird time to change your name. i think its best to wait until after the interview.

And should I need to add spouse name to passport ? If not changing name ?

the social security number is for married filing jointly. if you're filing separately and not claiming your spouse then you should not need a ssn or tax number. i would talk to a financial advisor if you want to claim your spouse on your taxes. i don't plan to.

I dont want to either and ive always used turbo tax to do my taxes, however, ive been reading that even if you choose married filing separately it will ask for a ss number or itin and if not it wont let you proceed. But i was told by someone here who has been through this process that you can file for an extension so you have more time to file your taxes.. for example the deadline is april 17 2018 with the extension you might a get another month or two and by then my wife should be here and they should have a ss number and the i'll file with her ssn.

My spouse will be here Saturday. While he's here, I'm getting the certified copy of his passport from the consulate here in Orlando and then I can apply for the ITN with the IRS and do my taxes so I'll have the funds for the next step in the process.....

I understand thats an option but i really dont want to get into more processes haha i have enough dealing with this wait at NVC. I much rather apply for an extension on the filing date and once my wife is here which i hope would be around april i will then file my taxes once she has her ssn. Remember you have to file taxes by April 17 2018 and if you get an extension you will have some more time, if you think your spouse will have her/his visa by then and will be in the US i think this is the easiest way to go. I received NOA2 last saturday, my attorney said my wife should have her visa by late march. I hope he is right.

Then i would just paper file. maybe use one of the free services offered by the government.

Fairly certain if you go that route you MUST file in paper form.  I think you would put your wife's name down and indicate non-resident alien, no ITIN.

The extension is a good option for you. Unfortunately, my PD is May 26 with Nebraska. So who knows when the amazing NOA2 will from the mythical land of Nebraska.

Exactly.. I did some research and it comes down to paper filing. Online programs such as turbo tax will not let you proceed without entering a SSN or ITIN even if filing married filing separately. Like you suggested @rmpiedra i think the extension will be my bes bet.
