A little off topic but - How is that even enforced? There is no objective test for "being high" that can be done at roadside like you can for alcohol. If they take the person to the station to send a sample, are there recognized "legal limits" established?

 

EDIT: Googled it myself - 5 ng of TCH in the blood, cops can arrest based on "symptoms" that are exhibited in the field. Very interesting.

  Not really. If we want to use lawsuits to hold politicians accountable, why stop at one issue. If its about using the legal system to hold politicians accountable for their 'reckless actions', then that rationale should apply across the board. If it can't hold up, you might want to rethink it.

 

  I could have used a different example. There are people in some areas of Colorado who can light their tap water on fire at times. Part of that is due to fracking in areas that are already geologically unstable from years of mining. Why not let courts decide if the politicians who allowed that were reckless and liable for damages? 

 

   I'm fine with using the electoral system to keep politicians in check by the way. It's really a collective thing. We vote someone there to represent us (the people), then by extension, we are responsible for those decisions.  Poor politicians are an extension of a poor electorate.

Simplest solution would be a plebiscite, but they would probably get the wrong result.
