We just received a RFE for a marriage certificate and I am certain that I included a official copy in the initial I-485 application.  The marriage certificate lists my wife's maiden name and the I-485 application and the RFE were made in her married name.  This is the only thing I can think of as to why they would send an RFE for the marriage certificate.

 

Anybody have this same issue?  Any suggestions or words of wisdom?

I am pretty sure we only sent one copy of the marriage certificate.  My wife has already received her EAD/AP government ID card and it has her married name on it.

 

I just worry because her maiden name is first-first-middle-maiden and her married name is first-first-maiden-married and am just hoping that they lost it.

 

The wording of the request was just in summary "submit certified marriage certificate between xxxx and xxxx".  It wasn't directly stated it was missing, but it seems implied.  I would assume if the 'wrong' marriage certificate was sent they would state something about it?

If we submit the marriage certificate again, just going on the assumption that they misplaced or lost it due to the EAD/AP needing it, and there is an issue or further clarification with the married name do they send another RFE?

 

I see a lot of threads where other Filipino/American couples filed the same way and had no or only minor issues, but we can't help but worry about it.

Its hard to tell what is going on in those offices.   I remember that when my Wife applied for her AOS we received and RFE stating that she was not eligible because we were not married within 90 days.   I was shocked to think that they could misread all of the evidence that was submitted.   To answer your question, I simply wrote a cover letter explaining the Date she arrived here and when we were married.  I also included another copy of our Marriage Certificate,  I-94, Copy of her K-1 Visa and a copy of the Entrance Stamp.   Just follow the instructions on the  RFE and you will be fine.  It did't take long for them to start working on the case again.   Good Luck.

2016.10.25 - Packet 4 received from Consulate (Interview scheduled 11/15/16)

2016.11.02 - Medical Exam completed

2016.11.15 - Visa Approved!! (90 Days)

2016.11.17 - Visa received via Thai Post

2016.11.30 - Arrived in the USA!! POE: Chicago
