Filling Writ Mandamus against The Department of State

The travel ban is now preventing issual of most IV visas. However, they arent rejected, just placed in admin processing. Since the waiver processing is now about 6 months old, in a few months, I think we will see folks starting to file writs. Unless ofcourse, the DOS decides they've put us through enough and starts approving waivers at a faster clip.

I would advise you to join the Facebook group Immigrants United. The admin is an Iranian immigration attorney in Wisconsin who has filed a lawsuit against the government based on the waiver issues. The are flat out rejecting most people, but many are also being put in admin processing. I’m not sure that writs will be successful in this scenario.

I know shabnam. But i haven't seen a lot of rejections for spouse/child. Many that were initially rejected were put back in AP. Are they still denying IR/CR cases? I have seen a single 9645 denial in over 2 months. Everyone who is interviewing is getting put into AP with a white paper that says 9645 on it. But very few actual visas. At some point a writ will force them to make the 9645 waiver determination.
